Interesting to note that Ole Miss was obligated not to say ANYTHING that would damage Houston Nutt's reputation, not just to not say anything false that would damage him.
In other words, unlike slander, the truth isn't a defense. Of course, it is obviously true that Ole Miss falsely disparaged Nutt to try to keep their recruits in the boat, but it doesn't even matter if they didn't
Nutt's attorney is a big-time litigator from a big-time firm ... you can bet that this won't be dismissed and will cause some serious heartburn for OM that has nothing to with any monetary damages. It sticks a dagger into the OM effort to portray Freeze as virtuous/oblivious. The way the suit is worded, you can tell that that is the intent.
This lawsuit is Hugh Freeze's death knell...

I thought it was also included to be quite about any ongoing NCAA investigation your school was under. OM was constantly trying to deflect Freeze's name from the investigation. They might have committed another violation. But it certainly adds credence to lack of institutional control.

Soo, this law suit could be Freeze's Waterloo or in this case Gettysburg. Umiss and Freeze are not going to be able to use political connections to get out of this one.

You know, the funny thing about all this is they could have avoided the suit entirely if they'd just issued a public apology. They still would have gotten reamed in the media but it would have been over by now. Do they have any grownups running the show over there?

I'm thinking the thought pattern here is that OM was thinking if they provided an apology it would have been seen as admitting guilt and there was still the possibility that Nutt would still sue them.
