Defendant leaves ex, ex gets mad and wants defendant punished!

Defendant's lawyer asks for no punishment due to ex's actions.

Judge: No punishment and we just leave out whether or not the ex did anything wrong.

Defendant's ex: Yay! We won! That proves we didn't do anything wrong! That lawyer didn't do squat!

I don't think you can be "punished" for leaving anyone even if defendant cheated. If you're talking about child support and alimony as financial punishment that's a different story.

Alienation of Affection is finding cause (blame) of a third party affecting cheater's actions.

UM, I think you missed the point.
