I don't really think its a new investigation, the original one never really stopped. But guys like Sallee are just really late to the party.

Second investigation before first has even been responded to, this is what I and some others thought would really hammer them and what brings the death penalty to the table. If true, this may be an unprecedented occurance of a repeat offender. As bad as SMU.

i still don't see how you are getting repeat offenders and thus the death penalty possibility out of it... You've got to be giilty of the first offense first.

They want get the death penalty, but you can hit them hard enough with schollys, penalty-free transfers, bowl bans, and show causes to set them back 10 years.

If the committee on infractions levies penalties on first NOA and then a 2nd NOA comes in behind it, then repeat offender is on the table. It's honestly to UM's benefit that any additional infractions be added to the 1st NOA rather than becoming a separate and subsequent NOA.

Rosie said this exact thing in his radio show last week - and he's been pretty spot on so far.

That's true. You have a 5 year window from when the penalties and probation phase starts. And if there are violations from any sport during that time you can face repeat offenders status. But there is also wording in that rule that allows the NCAA to extend to a time before the 5 year window, if there is a "pattern of willful violations" it can look back to when the violations first occurred. Even if it's prior to when the penalty phase started. That will be the debate. Since the penalty phase has not started, if there is a second investigation and NOA before the COI hands out the final penalties and starts the clock, will a 2nd NOA BEFORE the penalties start date from the 1st NOA trigger the repeat offender status. I believe the wording will allow for that and the NCAA would see it that way as well. It will be a very interesting and unique case to be sure. They still have the egregious violations wording which allows a school to get the death penalty without prior probation. Like they debated doing for Penn State.

ETA. I'm not saying they will get the death penalty. Just there is a case that the new investigations, if handled under a 2nd NOA, that repeat offender status could very well come in play and that is what puts the death penalty on the table in most cases.

What people are saying is that the NCAA could possibly deliver penalties this Fall and this current investigation drag out thru next summer or more- and a new set of penalties be necessary- that would be a repeat offender would it not?

I just hope if that is the case that they make it very clear that these penalties just address this section of violations and that there is more coming. I don't want any bear saying this is it and all we're going to get. I want it spelled out so the world knows that this is just the first 3" the NCAA gave them and that another 10" is still on the way so prepare thy anus.

It would not be repeat offenders unless it was improprieties that actually happened after they were already on probation.

Yes -- them continuing to cheat while under investigations is going to rub people the wrong way and probably increase the severity of their penalties.

I still disagree with that somewhat. Like I stated earlier in this post, there is wording for the repeat offenders rule that allow the NCAA to look at violations before the penalty phase window. A willful pattern can trigger that.
