It's amazing this story hasn't been followed up on. It's obvious from his remarks that the kid didn't just lose his passion for football. And to blame it on the kids disability, if that is not what really happened (and according to him it isn't), is just low.

We all know what it is. Ole Miss only wanted to flip a recruit from MSU to Ole Miss and Tee was their perfect pawn. If he has any eligibility left I say we sign him. Let him play in the Egg Bowl. Nothing for nothing and we know some of what happened that lead to a delayed signing day controversy with another UNM signee (how many signing day controversies have they had), but he had unofficially visited them and actually named them his leader that fall before signing day.

Sucks for him but you have to deal with consequences whether you were screwed over or not. This will be a DVR worthy 30 for 30 in a few years.

the one thing that might keep him quiet is the fact he wants to get back into football somewhere. He is going to have to sit one year to transfer and if he took gifts he could have to sit another year from the NCAA. If I was him I would work out a deal with the NCAA to spill the beans on Ole Miss.

Remember when Chad Bumphis tweeted out that you shouldn't go to a program because they give you things....you will ultimately be unhappy.

Had Tee come to MSU, he'd be another corner in the line of NFL corners Dan's staff has developed. Banks, Slay, soon to be Redmond and Calhoun. Shepherd would have been in that mix.

He took whatever it was that OM offered though, and this is the result. He made a career altering move, and it cost him.

He should definitely lawyer up since OM gave him an active football scholarship, but they revoked his position as a player because of his disability. By OM acknowledging his disability, and the fact that they would not play him because of his disability allows Tee to pursue a lawsuit.

The ADA law does allow for physical disability sometimes rendering you actually unable to preform a job. If it didn't you could have people with no arms suing to get jobs that require very heavy lifting. That being said since hand signals are used all the time in loud football stadiums I think UM would be screwed here if they took that line.

The analogy doesn't work in this situation since OM offered Tee an athletic scholarship. The scholarship should not have been offered if they believed the disability would hinder his performance.

The key to any of this speculation is, was he dismissed or did he quit out of frustration. If he quit, all Freeze had to do is keep his mouth shut and let him walk away and this would be old news. Freeze is like a bitter ex wife, he just had to get the last word in and it's coming back to bite him in the ass. Somebody needs to tweet Bonner and get him on it since UNM doesn't have a beat writer anymore. He could use the fact that Tee was going to State as an angle since he is the State beat writer.

Surely there is still some avenue he could pursue. I mean, every accommodation is provided in the classroom. I seriously doubt that there is 0 protection in the football environment. Again, if true, this smells like discrimination.

Just a few things:

Why wait until now to make these remarks? Why not a week or so ago when Freeze said T was having difficulties with his hearing loss?

Sure OM is not as well coached as other teams with similar talent (star) levels. But why are we seeing blow out losses to teams in which they are favored?

Just speculation, but could it be since the NCAA came sniffing around Tunsil, that the perks have become limited? Did T's disappointment come from unkept promises?

I get a sense of discontent, almost throughout the roster. And while Tunsil might not have been sitting on the couch munching on bowls of fruit loops for the last year, it's no easy trick to face either of the A&M defensive ends in his first game back.

The fan base is going to explode if OM loses 3 of the last 4 games.

I'm loading up on popcorn.

ADA is simply a civil rights law that prohibits discrimination to individuals with disabilities. OM offered Tee a scholarship knowing about his disability. Now, OM admits the disability hinders Tee's performance. OM is a public university, and I believe this could be a title II situation. By offering the scholarship, OM should have taken the steps necessary to communicate properly with Tee. They did not. His seclusion from the team for being disabled doesn't really allow him the same opportunity as every one else.

It's possible but not a given by any means. Like you said, it would be an original case, meaning no precedent. As you seem to know, Ada is a civil rights law that only applies if certain prerequisites are met, it doesn't bar all discrimination based on disability. Would have to be a title 2 case and would be an interesting analysis, and I'm sure om knew it was possible and that's why they framed tee departure as mutual.

I know some on here blame Tee and say screw Tee. To me that's nuts. These are kids that one don't know any better, and two, sometimes have adults in their lives not telling them the things that would be best for them.

How in the world someone can blame a teenager for this kind of stuff is beyond me. The purpose of college is to put practical use the skills learned at home and throughout your educational life. Well if you've never been taught in either of those mediums, you are going to make bad decisions. If kids knew how to make decisions that were in their best interest, there wouldn't be cheating in college football and kids would rat out cheaters without thinking twice about it. But that's not how it works because in the end, the kid is the one that suffers for the mistakes that the majority of times can be pinned on the adults around them.

So don't blame the kids people. Blame the adults. There is no way in hell Tee Shepherd just all of a sudden in a late night phone call decided to change his mind from us to OM. There had to be influence from those around him. The adults that help him make decisions didn't help him. And that's the real shame here. Not that Tee chose OM, but that the people around him didn't have the sense enough to tell him NOT to chose OM.

Sucks for him but you have to deal with consequences whether you were screwed over or not. This will be a DVR worthy 30 for 30 in a few years.

Good idea but I'd want the 30 for 30 to include all the players that there was this "inside" recruiting battle between MSU and Ole Miss not just Tee.

As a student (/athlete) the university made a binding decision in signing him to play a sport knowing full well his disability, and then forcing him out after publicly stating that his disability was the main reason.
With my memory foggy, I can't remember all the federal education and disability rights they violated, but I can tell you that since Hugh made a public comment on it, he opened a big box of bad juju for the athletic department. I will check back in in a couple days or less

I think that's the real sticking point here is the fact that Ole Miss/Freeze publically stated that they cut him because of his disability. They would have been a LOT better off just saying he was no longer part of the team and leaving it at that.

Ada applies to employment. And to a lesser degree, state and local governments. A football player is not an employee and I doubt the section pertaining to state govt would apply here.

Clearly received benefits, and therefore was employed by some institution.

To me, this proves Hugh will last minute recruit someone for the sole purpose of trying to screw MSU, and to the detriment of the player as well.
Freeze has recruiting skills but it is really hard to get douchier than that.

And yet some numbskulls fans still don't get why I don't pull for the bearsharks in anything. Why the hell would I ever pull for those bastards when they run their program with the intention of hurting MSU at every opportunity? 17 them. I hope the NCAA doesn't even use lubrication.

I think it's one of those things like a head coach. He officially resigned but if he didn't he would be shown the door. They probably told him he would never see the field again because he was deaf so he just left the team after realizing he had been sold a bunch of lies from Mr. Mission Trip.

Yup. Their hypocrisy is one of the main reason I hate them. They will preach about how they don't care about State, how State is below them, and how State doesn't matter until they are (pardon the pun) red and blue in the face. However, they will attack State any way they can and as much as possible.

Just depends on the something. Is it, contrary to that fanbase in preseason, he is not that good or does it have to do with the investigation? Or both? Cutting...I mean having even a below average player quit midseason still doesn't make sense. He could talk him into flipping over one, albeit really really long phone call, but couldn't or wouldn't talk him into playing our the season? Fishy

I am not a tax lawyer but what benefits would they have to pay taxes on? I know living expenses and insurance is not taxable. Would the cost of tuition and books be taxable even though it is a tax deduction?

No..... tuition, books and food allowance can all be claimed to adjust your income. So there wouldn't be any taxes there. I think the benefits would be more on the lines of gas allowance, additional non-athletic clothing allowance, recreational payments, and miscellaneous payments. All of these benefits were included in the case that was brought to federal court where universities wanted to offer students an additional $5,000 per year in compensation. Of course, the court did not allow the benefits and said that NCAA athletes were not employees. Somehow this entire case got referred to the Sherman Act, Section 1 where the federal government had the right govern the situation since some universities (pretty much every Div 1 school) began to sway from the amateurism honor code the NCAA demanded. Too bad this "honor code" they are so proud of is abused by nearly every school (some more than others).
