I entered into a contract in February to build a new home. The contract says I am suppose to take possession in a few weeks. As of today, Floors are not done, no counter tops, or tubs or toilets, a Cabinet isn't square, outside trim needs paint, landscaping not done..... No way he finishes in two weeks.


Anyway, question is, if he isn't finished in time, does that void the contract?

Also, the contract is a standard contract but specifically says I get my earnest money refunded by "builder default". What exactly is builder default? Not finishing on time?

I just want my money back at this point. I'm so fed up with this guy that I would rather find something else.

I have no clue but this is worthy of a real estate lawyer in a hurry, if for nothing else, just to review the contract and tell you your rights.
