DoE ruling on Title IX

Apparently the Department of Education has made a ruling that Title IX applies to direct payments to athletes.

My prediction: If the ruling holds, there will be a severing of MSU Sports, Inc. and the university at some point.

Most decision makers in the DoE are going to get replaced with the regime change. This decision is performative at most. Any arguments about this would be pointless on this board. This ruling is nowhere near final nor will be reality for the next 2-4 years.

Oh, I fully expect this to go the same route as the DoE ruling on LGTBQ and transgender athletes. The courts will be involved. I do expect this has more of a chance to make it through the courts, but not great. That's why I said "If".

However, I do see this as one more domino in the collapse of the system. Sooner or later, the legislature is going to have to get involved and define what is education and what is not. Student Athlete is no more.

This is not a Left-Right issue, this is Left-Left. It's like North Korea versus Iran.

The IQ-200 move is for the small schools to quietly support this and drive it. Why...

(1) Buckeye Ross Bjork can raise money to the moon and beyond. Let's say he raises $20M for NIL and a smaller southern school can only raise $6M. That's a $14M delta. If the Buckeye Ladies snake $10M, that reduces Ohio State vs Small Southern School gap to $7M.

(2) Also, let's say the smaller southern school has a small southern school rival that is currently out-raising them 6M to 13M (7M Gap) the new gap is 3.5M.

(3) Additionally, let's say a football-school can reliably haul money way in excess of football and another school, that likes baseball, can only cling to the minimum to finance decent 7-win football teams. The richer football school can double-up on football and still outspend the smaller school in baseball. Thus wrecking the Fall and Spring sports of the smaller school.

(4) I am sure you guys know this, but as a PSA. Indiana, Minnesota, Wisconsin, Iowa, Illinois, and Michigan State have more and richer Alumni than schools like LSU and Auburn. If it comes down to money, with the right motivation, the IU Hoosiers and Badgers could make Auburn and LSU into mid-tier. IU and UW have CEOs, COOs, CFOs, and Corporate Counsels in all the biggest global companies. Yes Auburn has the Apple CEO. As soon as a Ross Bjork get's hired in Bloomington and Madison, they are going to haul better than many people expect.

I wish I had a daughter playing a college sport. I would be encouraging her to file a lawsuit as soon as revenue sharing hits whether this ruling stands or not.

A lot of this is in response to the numerous lawsuits that have been filed last year. Including several Title IX lawsuits. This will also be a very volatile year until more definitions and structure gets litigated. I do think whatever happens in the end, someone will have to have authority and teeth to oversee what emerges.

Is that correct? Can an individual pursue both remedies or do they have to choose?

The AD isn't any better. This is their excuse to go wait and see while the football program continues to fall behind. Because heaven forbid we might lose some money.
