Not a lawyer, but I think that's a very key point. Had they been yelling to the heaveans that they got free stuff on a recruiting visit, it would be a different matter (but if it's true, they could still do that). OM was the one who released the information and the names, and it took them forever to release the content of the violation.

I don't expect the motions to dismiss to be granted prior to discovery. That is rare and only done when the complaint does not state a claim.
I am much more interested in the change of venue. From what little I have seen, I expect that to be granted and the motion to sever the defendants' cases to be granted.

Disassociation as far as business goes would probably only eliminate their ability to market at UM events or get current UM coaches to any type of marketing or event they would have. It isn't like UM could prevent RR from selling UM merchandise.

If anything I bet their business has increased, and would have decreased if this was not made public.
For the simple reason that reb fans would have slacked off buying due to investigations, but have increased buying in support of them.

Basically Rebel Rags doesn't buy merchandise from the school. They buy from apparel companies and licensed wholesalers like Collegiate. The school doesn't own or control those companies. So even if RR is disassociated, there isn't anything the school can do to stop their business.
In fact, if the school does dissociate them, then RR can give out even more free stuff to even more croots, and the school can claim they have done all they can to stop him. Which we all know would be BS

Good point. They sued Kobe and Leo and their names hadn't been released. Also, they didn't volunteer tis stuff. The NCAA asked them about it.

This right here is why the case will never go forward. These two anonymous SA were contacted by the NCAA to give honest testimony about the case that they had uncovered through their investigations. LL and KJ did not spread lies to the masses and such and the only way this was made public is through release, non compliantly, by OM to a third party and to the public of their names and the accusations.

They are playing with fire in my opinion. Nothing will come out of this that the NCAA will look fondly on, and State's already got a pass on the players in question. That's been established, yet they're still going forward with it? So why? It's not to win money from a couple of college students. The only reason they could possibly be pursuing this case, at this juncture, is if they're seeking to embarrass the NCAA for letting kids skate. They're trying to turn this into a news story, but the only ones who really care anymore are their own regular mouth pieces.

That. And RR is going to have a really hard time proving damages, which is the basis for this case.

The optics of this situation are bad even if OM got what they want, whatever that is. Discovery works both ways.
