If Mars has a sworn affidavit from either a player who had a burner, or a coach who used a burner, it is game over. I have a feeling that one of the coaches screwed up and called a kid's burner from an OM phone (probably Bucky), and that the burner in question had only calls from other burners or OM numbers. From the NCAA perspective, a sworn affidavit given voluntarily from either a former coach involved or a former recruit involved would be considered rock solid evidence. Especially if it is a former recruit who has no connection to the current NOAs - say one from the 2016 or 2017 signing classes.
OM is like the cheating husband that gets busted pants down with a hooker but continues to lie and say it wasn't me. At a certain point you have to just come clean. Continuing to lie and play games just digs a deeper hole and ensures that consequences will be even more devastating.
It's a control thing with OM. They want to own the player by giving them things they can't pay for. They think filling that want/need makes them indispensable, and will make the player loyal. It's how they show "love". Need a phone, we got one. Need a car, we got one - you can even change your mind about what kind. Momma need a house, no problem. Need new furniture? We have store for that. Want OM swag for your crew? Call **** and she will hook you up, here is her card.
It's interesting that their version of love, respect, and loyalty revolves around material things and the perceptions that they bring.
My bet is Kiffin signed the affidavit. Career-wise, he doesn't have much to lose and a lot more to gain at this point than say, Barney, by rolling.
The recruits didn't have the burner phones. The staff did. Bjork asked 20+ staff to sign a piece of paper if THEY DID NOT use a burner phone. Of course, they all signed it. But Mars thinks he knows otherwise, perhaps from a former staffer that said they did. We shall see what becomes of it.
