How does this farce go forward, it's a complete joke?
This is great. That response tears the whole premise apart.
This is ridiculous. They're so outmatched. It's unwinnable. I can't understand why a lawyer would take this case. They might make some money, but surely this damages their credibility in the legal profession. It's beyond embarrassing and incredibly irrelevant to the ongoing disaster in Oxford. I guess that's why the only publication still following this is the kingfish blog and their fan sites.
For us non-lawyer types, could someone please translate?
Also, in the comments, someone says that the FBI is indeed in Oxford.

The more I read about this case, the more I see how much I underestimated the silliness of it.
With each filing, it is more obvious that Rebel Rags goal is to get some deposition as ammo against the NCAA. The rest of the case and its claims are a joke.
I didn't read the response. Don't care enough. However it needs to say:
A1) no public statements were made, A2) if the defendants did not publish the statements, there is a clear lack of intent on their behalf to harm RR.
B1) They did not lie. B2) Other than verbal accusations in RR's complaint, they've offered no evidence that the testimony the defendants gave to the NCAA was a lie. B3) Further, others have corroborated the story in interviews with the NCAA, but they are not being sued.
C1) No damages have been realized. No damages have been claimed. C2) You might be able to actually argue that the filing of the lawsuit has helped RR's reputation amongst Ole Miss fans and bolstered his business, which is the exact opposite of what the claim is espousing.
D1) the individuals were compelled to testify and tell the truth to the NCAA or risk losing their eligibility or their step sons eligibility. D2) in fact, lying to the NCAA would risk their eligibility. As such, they had no self incentive to lie but a very compelling and necessary incentive to tell the truth. Eligibility > RR or Ole Miss scandal(s) to the parties involved.
And let me tell you something. Steve Robertson has been an absolute bird dog on all of this. But Kingfish can do it just as well, and has much more experience with the legal process and Public Records requests. He will fight for transparency.
And Matt Wilson, Miller's lawyer, is an excellent lawyer and a very intelligent man.
If Matt is as sharp as y'all say, he should be looking into the damages at RR in order to turn up the heat on them.
All records for all employees. Emails and phone. All records pertaining to the downfall of the football program are justifiably needed because he'll have to show that any down turn in RR's business is do to the football program tanking (Freeze escorts, 5-7 no bowl, self imposed bowl ban, etc...) and not do to any statements linked to his client. Subpoena EVERYTHING!!!!
That's what I don't get in this. Why in the world would the Rebs want to open everything up like that? They have to know it's possible. They would have to believe they truely have done nothing wrong. We all know that's not true because they have already admitted enough to bury them for a long time. Another possibility is that this Warren guy is trying to get out in front with the PR. If the NCAA hammers UM partly based on what was going on at RR if I was a Confederate I would never shop there again. The only other thing I can think of is that they know they are aborted to get nukes back to the stone age and all they have left is trying to take us down with them. I think it's probabaly a combination of the last two but who knows? I still can't believe they gave the people they say are trying to take them down in a NCAA case subpoena power. Unreal.
