Thought the word here was OM settled
So if a person sues a university across state lines it's still an in-state issue? That's asinine.
Either way, it doesn't matter. They're trying to find a friendlier court room, but the suit is pretty damn tight and regardless of where it's eventually heard it's going to be disastrously bad news for Dixie.
Mr. Mars gets to keep digging.
I see Mr. Mayo has moved from defending Freeze to all of ole miss and the IHL.
The attempts to settle have failed. Now OM is trying for a Hail Mary to get it booted.
Houston Nutt will get his pound of flesh.
These sons of bitches don't know when they're beat. It's almost like arguing with your old lady.
With Mars digging as hard as he is they are going to pay for this over and over again.
The Ole Miss case is not a good endorsement for The University of Mississippi Law School.
The longer this thing keeps going the more skeletons get pulled out. You would think at some point they would just cut their losses and start over.... the arrogance of this bunch is unbelievable.
Mississippi wanted to settle and ole Nutt said Nah, ya'll made my momma call me and ask if I did such a thing. Now, Ya'll gonna sweat for while and then you are gonna pay me!
Now that discovery has begun, Mars would be an idiot to settle. He's collecting more leverage as we speak. They haven't reached their pain threshold yet.
Isn't the motion to dismiss a standard response?
It is, but I do think there's a potential 11th amendment issue trying to sue a state entity in federal court on a state law based claim. If Ole Miss was a state agency, pretty sure the court would lack jurisdiction. If it were a municipality, the court would have jurisdiction. Not sure about a university. Money wouldn't come from state treasury, so maybe ok?
